Terms & Conditions
Please read this document carefully! It contains important information about your rights and obligations, as well as limitations and exclusions that may apply to you. This document contains a dispute resolution clause.
This Agreement contains the terms and conditions that apply to your purchase from Calgary Shooting Centre, Ltd., a Canadian Corporation (“CSC”, “our” or “we”) that will be provided to you (“Customer”) on orders for firearms, accessories and/or other products and/or services sold in Canada. By accepting delivery of the products and/or services described on the invoice, Customer agrees to be bound by and accepts these terms and conditions.
These terms and conditions apply unless the customer has signed a separate purchase agreement with CSC, in which case the separate agreement shall govern.
These terms and conditions are subject to change at any time without prior written notice, in CSC’s sole discretion.
1. Other Documents
Other than as specifically provided in any separate formal purchase agreement between Customer and CSC, these terms and conditions may NOT be altered or amended by the use of any other document(s). Any attempt to alter or amend this document or to enter an order for product(s) or services and support that are subject to altered terms and conditions will be null and void, unless otherwise agreed to in a written agreement signed by both Customer and CSC.
2. Governing Law
This agreement and any sales thereunder shall be deemed to have been made in the province of Alberta and shall be construed and interpreted according to the laws of the province of Alberta and the applicable laws of Canada. The parties hereby agree to the non-exclusive jurisdiction of the courts of the province of Alberta.
3. Payment Terms; Orders; Quotes; Interest
Terms of payment are within CSC’s sole discretion, and unless otherwise agreed to by CSC, payment must be received by CSC prior to CSC’s acceptance of an order. Payment for the products and services may be made by credit card, or some other prearranged payment method unless credit terms have been agreed to by CSC. If credit terms have been agreed to by CSC, invoices are due and payable within thirty (30) days after the date of the invoice. CSC may invoice parts of an order separately. Orders are not binding upon CSC until accepted by CSC. Any quotations given by CSC will be valid for the period stated on the quotation. Customer agrees to pay interest on all amounts past due at a rate of two percent (2.0%) per month.
4. Shipping Charges; Taxes
Separate charges for shipping and handling will be shown on the invoice(s). Unless Customer provides CSC with a valid and correct tax exemption certificate applicable to the product ship-to location prior to CSC’s acceptance of the order, the Customer is responsible for goods and services tax, sales and all other taxes associated with the order, however designated, except taxes on CSC’s net income. If applicable, a separate charge for taxes will be shown on the invoice.
5. Title; Risk of Loss
Title to products passes from CSC to Customer on shipment from CSC’s facility. Loss or damage that occurs during shipping is Customer’s responsibility. CSC is not liable for delays in shipment or failure to ship by the estimated ship date. Where customer has ACCEPTED to insure their shipment (at time of order) then CSC will assist customer with, but is not liable for, their insurance claim against the shipping company for loss or damage. Where customer has DECLINED to insure their shipment (at time of order) then CSC is not liable for or in any way responsible for any loss or damage however caused.
6. Warranties
The limited warranties applicable to products sold by CSC are the sole responsibility of the product manufacturer offering such warranties. CSC disclaims all warranties and conditions, express or implied, including without limitation implied warranties or conditions of merchantability and fitness for a particular purpose. CSC’s sole responsibility for warranty claims is limited to assisting the customer to contact the manufacturer. Some provinces do not permit the exclusion of certain implied warranties or conditions or limitations on how long an implied warranty or condition lasts in consumer transactions. Therefore, the foregoing disclaimers may not apply to you.
CSC does not warranty or guarantee the function, condition, or safety of:
- Consignment, surplus, or used items.
- Ammunition.
7. Shipping
All orders are typically processed within 24 business hours.
We can ship to virtually any address in Canada, however there are restrictions on some products, and some products cannot be shipped to some destinations. Some products are available for in-store pickup only and are not eligible to be shipped. Also, please note that we do not sell or ship internationally.
Occasionally there are delays outside of our control that prevent our carriers from being able to make their scheduled pick-ups. Once your order is picked up by the carrier and leaves our facility, you’ll receive an automated email with tracking information. If you didn’t receive this email, please check the spam folder of your inbox. If you wish to make a change to your order before it ships, please contact us as soon as possible.
When you place an order, shipping costs will be generated for you based on the product weight, product type, availability of your items, and the shipping option you choose. Depending on the shipping provider you choose, time in transit estimates may appear alongside the shipping quotes. Estimated transit times are provided by the shipping provider you choose at checkout, not by CSC.
If you have purchased a firearm that is subject to Chief Firearms Office (CFO) transfer approval, we will ship your firearm when we have received notification that the transfer has been approved.
Please also note that the shipping rates for many items we sell are weight-based. To reflect the policies of the shipping companies we use, all weights will be rounded up to the next full pound. Weight-based shipping rates are provided by the shipping provider you choose at checkout, not by CSC.
- Canada Post
All orders being shipped to a P.O. Box must be shipped via Canada Post. Orders containing ammunition or gunpowder cannot be shipped via Canada Post. - UPS
UPS will only accept shipments to a valid street address and does not deliver to P.O. Boxes. Orders containing ammunition or gunpowder can be shipped via UPS to a street address only, and cannot be delivered to a P.O. Box. Orders containing firearms cannot be shipped via UPS. - In-Store Pickup
If you selected In-Store Pickup, please wait until you receive your pickup confirmation email before heading to the store. When you've received your pickup confirmation email, we ask that you bring two pieces of ID with you. At least one piece of ID must be government-issued photo ID (eg. driver's license). Once you've arrived, visit our customer service counter and we'll retrieve your order for you.
8. Return Policy
If you find yourself considering returning a product, that likely means you ordered a product from us. Which means we owe you a "thank you!" Nothing makes us happier than a satisfied customer, and as such we strive to deliver an amazing shopping experience. That said, here are some things you may want to know...
- You may cancel an order at any time prior to shipment.
- You may return most new, unopened items within 14 days of the original purchase date for store credit equal to the purchase price. We'll also pay the return shipping costs if the return is a result of our error (eg. you received an incorrect or defective item). All products returned, not as a result of our error, are subject to a 20% restocking fee and associated shipping costs. Any CSC points earned during the purchase will also be returned.
- All pistols, surplus or used rifles and shotguns, consignment items, ammunition, reloading components, body armor, vaults/safes, gift cards, clearance items, and special orders are considered to be final sale and are not eligible for return.
- You should expect to receive your refund within four weeks of giving your package to the return shipper, however, in many cases you will receive a refund more quickly. This time period includes the transit time for us to receive your return from the shipper (5 to 10 business days), the time it takes us to process your return once we receive it (3 to 5 business days), and the time it takes your bank to process our refund request (5 to 10 business days).
If you have decided to return an item, please contact us with your order number and details about the product you would like to return. We will respond with instructions for how to return the item(s) from your order.
9. Exchange Policy
Any new product purchased from CSC that is found to be defective or damaged may be exchanged for another of the same product within 14 days of the original purchase date. If a replacement product is unavailable, we will gladly offer CSC store credit equal to the purchase price.
All pistols, surplus or used rifles and shotguns, consignment items, ammunition, reloading components, body armor, vaults/safes, clearance items, and special orders are considered to be final sale and are not eligible for exchange.
If you wish to exchange an item, please contact us with your order number and details about the product you would like to exchange. We will respond with instructions for how to exchange the item(s) from your order.
10. Price Match Policy
We guarantee our everyday competitive prices. If you find a lower everyday advertised price on an identical in-stock item (brand, size, model number) currently offered at any Canadian retail competitor’s store or website, before making your purchase and upon request, we will match their everyday price.
*Competitor close-outs, errors or misprints, discontinued, clearance, liquidations, special orders, damaged items, financing offers, short term door crashers / limited time sales, member only pricing, restricted offers, mail order offers, rebates, coupons, free or bonus offers, limited or minimum quantity offers, etc. are excluded from the Price Match Policy.
11. Products
11A. Products Disclaimer
CSC continually upgrades and revises its products / inventory to provide its customers with new choices. CSC (and the product manufacturers) may revise and discontinue products at any time without prior notice to customers. CSC will ship products that have the functionality and performance of the products ordered, but changes between what is shipped and what is described in a specification sheet or catalogue are possible.
Some images may be stock photos and may not be an exact representation of the selected product as described. Unless specifically listed as included, accessories shown such as scopes, optical sights, rings, ring mounts, optic rails, bipod rails, ammunition, etc. are not included.
11B. Consignment, Surplus, Used Products
All consignment, surplus, and used products are presumed to be in functioning condition, however the condition of each product varies and cannot be guaranteed.
CSC does not warranty or guarantee the function, condition, or safety of consignment, surplus, or used products.
12. Limitation of Liability
CSC (including CSC’s affiliates, officers, directors, employees or agents) does not accept liability beyond the remedies set forth herein, including any liability for products not being available for use. CSC will not have any liability for any damages arising from the use of the products in any high risk activity, including, but not limited to, law enforcement duties, training, or military operations, CSC will not be liable for lost profits, loss of business, or other incidental, indirect, consequential, special or punitive damages, even if advised of the possibility of such damages, or for any claim by any third party except as expressly provided herein. Customer agrees that for any liability related to the purchase of products or services, CSC is not liable or responsible for any amount of damages above the aggregate dollar amount paid by customer for the purchase of products and/or services under this agreement. The foregoing limitations apply regardless of the cause or circumstances giving rise to such loss, damage or liability, even if such loss, damage or liability is based on negligence or other torts or breach of contract (including fundamental breach or breach of a fundamental term). Neither CSC nor customer may institute any action in any form arising out of this agreement more than six (6) months after the cause of action has arisen, or in the case of nonpayment, more than six (6) months from the date of last payment. Some provinces do not allow the exclusion of limitation of (I) incidental or consequential damages or (ii) implied warranties or conditions, so the above exclusions may not apply.
13. Dispute Resolution
13A. Acknowledgments
Customer acknowledges that CSC possesses valuable confidential and proprietary information, that would be damaging to CSC if revealed in open court. The parties further acknowledge and agree that it is preferable to resolve all disputes between them confidentially, individually, and in an expeditious and inexpensive manner. The parties accordingly acknowledge and agree that private dispute resolution is preferable to court actions.
13B. Good Faith Negotiation
Before commencing any arbitration in the manner set out in Subsection 13(c) below, the parties shall first attempt to resolve any dispute or differences between them by way of good faith negotiation. The good faith negotiation shall commence by each party communicating their position regarding the complaint, claim, dispute, or controversy to the other party, and how the parties should resolve the dispute. The parties shall then make good faith efforts to negotiate a resolution of the claim, dispute, or controversy. Neither party shall commence any arbitral proceedings unless and until the good faith negotiation fails.
13C. Arbitration
ANY CLAIM, DISPUTE, OR CONTROVERSY (WHETHER IN CONTRACT, TORT, OR OTHERWISE, WHETHER PREEXISTING, PRESENT OR FUTURE, AND INCLUDING STATUTORY, COMMON LAW, INTENTIONAL TORT AND EQUITABLE CLAIMS CAPABLE IN LAW OF BEING SUBMITTED TO BINDING ARBITRATION) AGAINST CALGARY SHOOTING CENTRE, LTD., its agents, employees, officers, directors, successors, assigns or affiliates (collectively for purposes of this paragraph, “CSC”) arising from or relating to this Agreement, its interpretation, or the breach, termination or validity thereof, the relationships between the parties, whether pre-existing, present or future, (including, to the full extent permitted by applicable law, relationships with third parties who are not signatories to this Agreement), CSC’s advertising, or any related purchase SHALL BE RESOLVED EXCLUSIVELY AND FINALLY BY BINDING ARBITRATION ADMINISTERED BY THE NATIONAL ARBITRATION FORUM (“NAF”) under its Code of Procedure and any specific procedures for the resolution of small claims and/or consumer disputes then in effect (available via telephone at 1-800-474-2371). The arbitration will be limited solely to the dispute or controversy between Customer and CSC. Any award of the arbitrator(s) shall be final and binding on each of the parties and may be entered as a judgment in any court of competent jurisdiction.
13D. Injunction Relief and Provisional Relief in Aid of Arbitration
Notwithstanding the provisions in this Section 13 or anywhere else in this Agreement, CSC shall have the right to seek and obtain any provisional or interim relief from any court of competent jurisdiction to protect its trademark or property rights or to preserve the status quo pending good faith negotiation and/or arbitration.
14. Applicable Law; Not For Resale
Customer agrees to comply with all applicable laws and regulations of the various provinces and of Canada. Customer agrees and represents that it is buying for its own use only, and not for resale. CSC has separate terms and conditions governing resales.
15. Exports
The Customer acknowledges that the products sold hereunder are subject to, and Customer agrees to comply with the export control laws and regulations of Canada and the United States. Firearms, firearm parts/components and accessory items are export controlled under the International Traffic in Arms Regulations (ITAR). These products cannot be exported from Canada without a license approval from DFAIT (in Ottawa) and approval from the DDTC (US State Department) which authorized the original export to Canada under an appropriate license. 16. Headings
The section headings used herein are for convenience of reference only and do not form a part of these terms and conditions, and no construction or inference shall be derived therefrom.
17. Force Majeure
CSC shall not be liable for any delay or failure in performance caused by circumstances beyond its reasonable control.
18. Price Disclaimer
All prices are subject to change without notice. CSC is not responsible for typographical errors or any unpredictable digital oddities which may occur.
